The U.S. District Court has dismissed an artists’ class action complaint about the use of copyrighted images to AI generators. The court found that the two artists had never registered their works with the Copyright Office.

After that, lawyers for the artists filing the lawsuit said they would file an amended complaint next month. They also added that they were confident that they would eventually win the case.

The artists who sued claimed that the companies behind popular AI image generators were guilty of direct and partial copyright infringement. Since text prompts can create images “in the style” of their work, each generated image should be considered an author’s work.
